Please read these before signing. Proposed commercial account terms for Mechanical, Electrical and Plumbing Partners, LLC, referred to below as MEP.
1. Credit approval. Submitting this application does not establish a credit account or require MEP to accept work. Credit limits apply across the applicant account, including unbilled work and retainage. Each related entity must obtain separate approval.
2. Payment. Default terms are net 30 days from receipt of a proper invoice for satisfactorily completed work, unless a signed project agreement provides otherwise or applicable law requires earlier payment. Contractual retainage must be separately stated. Applicant will pay undisputed amounts when due and will identify any disputed item, the contractual basis, and the amount in writing promptly and within any applicable legal deadline.
3. Finance and collection charges. No contractual interest rate is created by this application; any agreed rate must be stated in a writing separately accepted by both parties. Statutory interest rights remain available. Applicant agrees to pay reasonable collection costs and attorney fees incurred to recover overdue amounts, to the extent permitted by applicable law and the governing signed agreement.
4. Future credit and existing work. MEP may decline new orders or reduce future credit based on payment history or credit information. Any suspension or termination of existing work will comply with the applicable contract and law, including required notices and cure periods.
5. Job information and changes. Applicant will provide a completed job information sheet before work starts on each job and will promptly report changes to ownership, legal name, registered agent, financing, permits, lien agents, bonds, or project transfers. Applicant authorizes MEP to verify commercial credit references and business information; separate consent will be obtained for any consumer report that requires it.
6. Project agreements and rights. This application does not override a conflicting signed project agreement or mandatory law. Contract changes require written acceptance by authorized parties. No lien, bond, statutory payment, or other remedy is waived by this application. Listing an owner does not create a personal guaranty.
